LOCAL PICKUP<\/h2>\n

At this time we offer our members a place in the south end of Barrie in a commercial complex for pickup of items. We offer pickup at this time to our members on Thursdays 12-5pm (Please check before coming as these times can change seasonally and for other reasons) we do ask that you BOOK A PICKUP TIME<\/strong><\/a> if you can to help speed things up when you come to pick up your items.<\/p>\n

BUY IT NOW SALES<\/h2>\n

We are doing BUY IT NOW<\/strong><\/a> live video sales and have an extensive ONLINE STORE<\/strong><\/a> catalog that we have local pickup for our members.\u00a0 We DO NOT have a store and WE ARE NOT open to the public.\u00a0 All buyers must register for an account with us before making a purchase.\u00a0 We are a MEMBERS ONLY ecommerce website.<\/p>\n

Why?<\/strong><\/span> At this time the CITY OF BARRIE byLaw enforcement has asked us to stop doing online auctions in Barrie with local pickup.\u00a0 We will update the website if and when this changes. At this time please check out our online store and our live video BUY IT NOW sales.\u00a0 If you wish to purchase items from Auction please visit our sister website https:\/\/midlandauctions.ca (Same Software) and pickup for that is just outside ELMVALE ONTARIO on highway 93. Sorry we can not offer local pickup in Barrie at this time for any online auctions.<\/p>\n

Still not sure how this applies to us, here is info from the barrie bylaw if you want to see it yourselves as we have had lots of questions and angry barrie residence over this. We just do not have the resources to fight this legally so we will submit and cease all online auction sales even though we are a ONLINE auction with no actual auctioneer or person conducting the sale as the computers conduct the sales (same as ebay, whatnot, hibid, maxsold, etc.. etc..) any of those platforms all allow local pickup. We do not feel that any of this bylaw pertains to us or our business. We are NOT auctioneers and we do NOT hold public auctions. We are a online auction that has a local pickup and we are REGISTERED MEMBERS ONLY as well.\u00a0 We feel we should be exempt from this PUBLIC AUCTION byLaw and if the city wishes to enforce online businesses with locations in Barrie they should create more suitable bylaws.\u00a0 This bylaw requires that we obtain a AAO accreditation that requires a auctioneer school certificate (for learning how to CALL\/CHANT like live auctioneers do, we do not do live auction and do not wish to go to a course on this that costs 2000.00 and pay a 200.00 fee per year for the accreditation plus the cost of this bylaw license that also requires all sorts of inspection and approval procedures as well). Anyway that is our rant. It is what it is…..<\/p>\n

Barrie ByLaw pertaining to PERSONS who conduct sales by auction and PUBLIC AUCTION sales… (This is what they told me I needed to obtain)<\/h3>\n

Here is what we feel they claim pertains to us (but I can not imagine this would hold up in any legal court but court costs to battle this are costly and your battling against those who are not using their own finances to pay legal fees).<\/strong><\/p>\n

1.1.9.0.0 AUCTIONEER – means a person<\/strong><\/span> who conducts a sale by auction.<\/p>\n

1.1.10.0.0 AUCTION – means a public sale<\/strong><\/span> to persons in which bids on goods, articles,
\nmerchandise, effects, etc. are received by an auctioneer and where each bid offers
\nmore than the last previous bid, the article being put up being sold to the highest
\nbidder. Shall not include a mock auction, silent auction or Chinese auction.<\/p>\n

1.1.11.0.0 MOCK AUCTION – means an imitated sale by auction of goods, articles,
\nmerchandise, effects, etc. to persons.<\/p>\n

1.1.12.0.0 SILENT AUCTION – means an auction conducted by means of written bids given
\non displayed goods wares or merchandise with the final declaration of sale being
\nmade to the last individual having submitted a bid on the specified bid sheet for that
\nitem.<\/p>\n

1.1.13.0.0 CHINESE AUCTION – means an auction conducted by means of predetermining a
\nset price on an item, thence receiving verbal bids on such an item. The final
\ndeclaration of sale shall be made to the highest bidder who shall then pay the price,
\nbased on the difference between the predetermined price and the highest bid.<\/p>\n

8.0.0.0.0 AUCTIONEER

8.1.0.0.0 Deleted<\/p>\n

8.2.0.0.0 OPERATING CRITERIA<\/p>\n

8.2.1.0.0 No person shall sell or put up for sale goods, wares, merchandise or effects by<\/strong><\/span>
\npublic auction within the City without first having obtained a licence<\/strong> <\/span>to do so.<\/p>\n

8.2.2.0.0 The applicant shall provide to the Issuer of Licences at the time of application, proof
\nof liability insurance in the minimum amount of $2,000,000.<\/p>\n

8.2.3.0.0 Upon receipt of the application the Issuer of Licences may make inquiries to the
\nChief of Police, regarding the application and the Chief of Police shall certify the
\nresult of his inquiries.<\/p>\n

8.2.4.0.0 The auctioneer shall, at each auction, prominently display his licence issued
\nsubsequent to this Section, and shall in all public advertisements of any nature used
\nby him in the course of his business, include his municipal licence number.<\/p>\n

8.2.5.0.0 No auctioneer shall:<\/p>\n

a) permit any disorder in his auction room or offices;
\nb) conduct or permit to be conducted any mock auction;
\nc) knowingly make or permit to be made any misrepresentation as to
\nthe nature, content, quantity or value of any goods, wares,
\nmerchandise or effects which may be offered for sale by him;
\nd) give away articles or sell them for nominal amounts for the purpose
\nof stimulating bidding;<\/p>\n

e) do any act that is calculated to or which may reasonably have the
\neffect of confusing a purchaser as to the amount he pays for any
\narticle(s);<\/p>\n

f) by deceit, falsehood, or other fraudulent means stimulate or raise
\nbids or cause to stimulate or raise bids affecting the selling price of
\nany item offered for sale to the public by public auction;<\/p>\n

g) sell or put up for sale by auction any goods, wares, merchandise
\nor effects held on a reserve bid basis without first announcing to
\nthose in attendance at the auction the fact that such item is held on
\na reserve bid.<\/p>\n

8.2.6.0.0 Every auctioneer shall advise the Issuer of Licences a minimum of seven (7) days in
\nadvance, the time, date and location of every auction scheduled by such auctioneer.<\/p>\n

8.2.7.0.0 Nothing herein contained shall apply to a Sheriff or Bailiff Sale.<\/p>\n

8.2.8.0.0 Every auctioneer shall keep proper books of account of the business transacted by
\nhim as an auctioneer which books shall give the names and addresses of the
\nowners of the goods, wares, merchandise or effects to be sold, the description of
\nthe same, the price for which the same may be sold, the names and addresses of
\nthe persons purchasing such goods, wares, merchandise of effects or any portion
\nthereof, the price for which the same was sold and the auctioneer shall forthwith,
\nafter the sale of same, or any portion thereof, account for the proceeds and pay the
\nsame to the person(s) entitled to such proceeds, less the auctioneer’s legal and
\nproper commissions and charges; and he shall, in case no sale is made of such
\ngoods, on payment of his proper costs and charges, return such goods to the
\nperson(s) entitled to receive such goods on proper demand being made for such
\ngoods.<\/p>\n

8.2.9.0.0 Nothing in this section shall in any way affect or invalidate the claim of any
\nauctioneer for goods warehoused with him, and on which he has made advances.<\/p>\n

8.2.10.0.0 Service clubs and registered charitable organizations conducting Silent Auctions
\nand Chinese Auctions, and as approved by the Issuer of Licences shall be exempt
\nfrom the provisions of this by-law.<\/p>\n

8.2.11.0.0 Every applicant shall provide, at the time of application, proof of membership with
\nthe Auctioneers Association of Ontario.<\/p>\n

8.2.12.0.0 Every licensee shall maintain membership in good standing with the Auctioneers
